Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Flagmint platform, website, APIs, SDKs, and related services (collectively, the "Service") provided by Just Izzy Ltd (trading as Flagmint) ("Just Izzy", "we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Definitions
"Organisation", "Customer", or "you" means the entity that creates an account and uses this Service, including our authorized agents, servants or privies. Who your account operates and including all projects, flags, and team members within it.
"End User" means any individual whose data is processed through the Service via the organization's use of our SDKs or APIs.
"SDK" means any software development kit provided by Flagmint that allows the organization to integrate the Service into their applications.
"API" means any application programming interface provided by Flagmint that allows the organization to interact with the Service programmatically.
"Agreement" means these Terms together with our Privacy Policy, Data Processing Agreement, and order agreements as we may propose to the organisation based on it's plan selections.
2. Account Registration
To use the Service, you must create an account with a valid email address and accurate information. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@flagmint.com if you become aware of any unauthorised use of your account.
3. Use of the Service
Subject to these Terms, Just Izzy Ltd grants you a non-exclusive, non-transferable, revocable licence to access and use the Service for your internal business purposes. You may integrate our SDKs into your applications and use our APIs to manage feature flags, targeting rules, and related functionality within the limits of your plan.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations;
- Attempt to gain unauthorised access to the Service, other accounts, or our infrastructure;
- Interfere with or disrupt the integrity or performance of the Service;
- Reverse engineer, decompile, or disassemble any part of the Service;
- Use the Service to process special categories of personal data (as defined in GDPR Article 9) unless you have obtained appropriate consent from us;
- Resell, sublicence, or redistribute the Service without our prior written consent;
- Use the Service to build a competing product or service.
5. Plans and Pricing
The Service is available under multiple plans: Free, Pro, Growth, and Custom. Plan details, feature limits, and pricing are described on our Pricing page at flagmint.com/pricing. We reserve the right to modify pricing subject to at least 30 days' notice issued before your next billing cycle. Free plan accounts are subject to usage limits as described on the Pricing page; exceeding these limits will result in request throttling, not service termination. Cached SDK settings will continue to function during throttling.
6. Payment and Billing
Paid plans are billed in Euros (€) on a monthly basis. Payment is processed securely via Stripe. By subscribing to a paid plan, you authorise us to charge your payment method on a recurring basis. All payments are non-refundable. If payment fails, we will notify you and provide a reasonable grace period (minimum 7 days) before suspending access to paid features. API usage overage is billed in full 1 million call blocks at the rate specified for your plan.
7. Free Plan
The Free plan is provided at no cost and includes limited usage as described on the Pricing page. The Free plan is intended for evaluation and small-scale use. We reserve the right to modify Free plan limits without notice. Free plan accounts that remain inactive for 12 consecutive months will be removed without any notice.
8. Intellectual Property
Flagmint retains all rights, title, and interest in the Service, including all software, APIs, SDKs, documentation, trademarks, and related intellectual property. These Terms do not grant you any rights to our intellectual property except the limited licence described in Section 3. You retain all rights to your data, configurations, and any content you create or upload through the Service. By using this Service, you grant Just Izzy Ltd a limited licence to process your data solely to provide and improve the Service as described in our Privacy Policy.
9. Your Data
You own all data you submit to the Service, including flag configurations, targeting rules, and any end-user data processed through our SDKs. We process this data in accordance with our Privacy Policy and, where applicable, our Data Processing Agreement. You are responsible for ensuring that your use of the Service complies with all applicable data protection laws, including obtaining any necessary consents from your End Users. Upon termination, you may export your data via the platform's export feature for up to 30 days.
10. Availability and Support
We aim to provide the Service with reasonable availability but do not guarantee uninterrupted or error-free operation. The Service is provided on a best-effort basis. We may perform scheduled maintenance with reasonable advance notice where possible. In the event of unplanned downtime, we will make reasonable efforts to restore the Service promptly. Support is available via email at support@Flagmint.com. Response times vary by plan.
11. Violations and Enforcement
If we become aware of a violation of these Terms, we will first notify you of the violation and provide a reasonable opportunity (minimum 7 days) to remedy it, except in cases of serious violations that pose an immediate risk to the Service, other customers, or security. If the violation is not remedied within the specified period, we reserve the right to suspend or terminate your account. In cases of serious violations (including but not limited to: illegal activity, deliberate security attacks, or actions causing harm to other customers), we may suspend access immediately and notify you thereafter.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Just Izzy Ltd's total aggregate liability arising out of or in connection with these Terms or the Service shall not exceed the total amount paid by you to Flagmint in the twelve (12) months immediately preceding the event giving rise to the claim. In no event shall Just Izzy Ltd be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, business, or goodwill, regardless of the theory of liability. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or wilful misconduct.
13. Indemnification
You agree to indemnify and hold harmless Just Izzy Ltd, its officers, and its agents from any claims, losses, or damages (including reasonable legal fees) arising from: your use of the Service in violation of these Terms; your violation of any applicable law or regulation; or any dispute between you and your End Users relating to data processed through the Service.
14. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Just Izzy Ltd does not warrant that the Service will meet your specific requirements, operate without interruption, or be free from errors or vulnerabilities.
15. Term and Termination
These Terms are effective from the date you create an account and continue until terminated. You may terminate your account at any time through your account settings or by contacting us at support@flagmint.com. For paid plans, termination takes effect at the end of your current billing period; no prorated refunds are provided for partial billing periods. We may terminate or suspend your account in accordance with Section 11. Upon termination, your right to use the Service ceases immediately, but you may export your data for up to 30 days as described in Section 9.
16. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice in the platform at least 30 days before the change takes effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you may terminate your account before the effective date.
17. Governing Law and Disputes
These Terms are governed by the laws of England and Wales. All disputes arising from or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts of England and Wales, United Kingdom. Before initiating legal proceedings, both parties agree to attempt to resolve disputes in good faith through direct communication for a period of at least 30 days.
18. General Provisions
If any provision of these Terms is held to be unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. These Terms, together with the Privacy Policy, Data Processing Agreement, and any applicable order forms, constitute the entire agreement between you and Just Izzy Ltd regarding the Service. You may not assign or transfer your rights under these Terms without our prior written consent. Just Izzy Ltd may assign its rights and obligations under these Terms in connection with a merger, acquisition, or sale of all or substantially all of its assets.
